Terms of Use

Effective September 20, 2026; last updated October 16, 2026

These Terms of Use (“Terms”) govern your access to and use of the Crux AI website, private beta, mobile app, and related services (together, the “Services”). The Services are operated by Jonathan Giovannetti, referred to in these Terms as “Crux,” “we,” “us,” or “our.” Crux AI is the app and service name.

Important

  • Crux provides educational climbing feedback, not medical advice.
  • AI analysis can be incomplete or wrong. Use your own judgment.
  • Climbing is inherently risky; follow facility rules and qualified instruction.
  • Crux Pro subscriptions renew through Apple until you cancel them.

1. Accepting these Terms

By accessing or using the Services, requesting beta access, or selecting a control that states you agree, you accept these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.

You must be legally able to enter into these Terms. If you are under the age of majority where you live, a parent or legal guardian must review and accept these Terms for you and supervise your use. The Services are not directed to children under 13.

2. The Services and beta features

Crux lets you provide climbing context, select a climbing video, receive AI-assisted movement observations and coaching cues, save analyses locally, and organize training tasks. Features, availability, and subscription offerings may differ by release or region.

Beta and preview features are experimental. They may contain errors, change without notice, have limited capacity, or be discontinued. We may modify or stop all or part of the Services, but changes to paid access will remain subject to applicable law and the purchase terms shown to you.

Subject to these Terms and applicable platform terms, Crux grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control for personal, non-commercial purposes.

3. Crux Pro subscriptions

Some features require an auto-renewing Crux Pro subscription. Before you confirm a purchase, Apple displays the subscription name, duration, current localized price, and any trial or introductory offer. Apple charges your Apple Account when you confirm. Your subscription renews automatically for the same duration at the then-disclosed price unless you cancel at least 24 hours before the current period ends or Apple tells you a different deadline. Preview access and sample plan selections do not create a paid subscription.

Manage or cancel your subscription in your Apple subscription settings. Deleting the app or your local data does not cancel a subscription. If a free trial is offered, any unused portion ends when you purchase a subscription where applicable. Purchases, billing, cancellations, and refunds are processed under Apple’s applicable terms and policies. Crux does not receive your complete payment-card information.

Use the Restore control in the app with the Apple Account that made the purchase to check for an eligible existing subscription. Restoring does not start a new subscription; access depends on the purchase status that Apple and our subscription provider can verify.

Paid access continues for the period you purchased, subject to these Terms. If we stop providing a paid feature during an active period, your rights and any remedy are governed by applicable law and Apple’s purchase policies.

4. Acceptable use

You agree not to:

  • use the Services unlawfully or violate another person’s rights;
  • upload content you do not have permission to use or analyze;
  • attempt to identify, profile, harass, or make consequential decisions about another person using an analysis;
  • probe, disrupt, overload, bypass, or interfere with security, access controls, rate limits, or normal operation of the Services;
  • reverse engineer, scrape, extract models or training data, or use automated access except where applicable law expressly allows it; or
  • resell the Services, misrepresent generated feedback as professional advice, or use Crux branding without permission.

We may investigate suspected misuse and suspend or terminate access when reasonably necessary to protect users, the Services, or third parties.

5. Your content and privacy

You keep ownership of videos, notes, and other content you provide (“Your Content”). You grant Crux a limited, worldwide license to host, transmit, reproduce, and process Your Content only as needed to operate, secure, and improve the features you request, enforce these Terms, and comply with law. This license ends when the content is no longer needed for those purposes, subject to lawful retention and service-provider processing described in our Privacy Policy.

You represent that you have the rights and permissions needed for Your Content, including permission from recognizable people where required. Follow the recording and privacy rules of your gym, venue, or event. Avoid recording bystanders, children, or private information.

Your source video stays on your device. For a requested analysis, the app sends sampled still images and relevant climb context to contracted analysis service providers; it does not upload the raw source video. Details are in the Privacy Policy.

6. AI limitations and climbing safety

Crux uses automated systems to interpret a limited set of video frames. Generated observations may be inaccurate, incomplete, outdated, or unsuitable for you. Sampled frames can miss fast movements and cannot determine pain, fatigue, force, intent, hold quality, equipment condition, or every environmental risk. Always review feedback critically and stop if anything feels unsafe.

The Services provide general educational information only. They are not medical, rehabilitation, emergency, or professional climbing instruction and do not replace a qualified coach, guide, route setter, clinician, or facility staff member. Do not use Crux to diagnose or treat an injury. Seek appropriate professional care for pain, injury, or health concerns.

Climbing and training involve risks of falls, equipment failure, collision, and serious injury or death. You are responsible for evaluating conditions, choosing activities appropriate to your abilities, using proper equipment and spotting or belay practices, following facility and manufacturer rules, and obtaining qualified supervision. Never attempt a move or drill solely because Crux suggested it.

7. Crux content and intellectual property

The Services—including software, design, text, graphics, coaching catalog, trademarks, and other Crux-provided content—are owned by Crux or its licensors and protected by law. Except for the limited license above, these Terms do not grant you any right to that material. Feedback you voluntarily provide about the Services may be used without restriction or compensation, but we will not publicly identify you as its source without permission.

8. Third-party services and Apple terms

The Services rely on Apple and contracted providers for analysis, subscriptions, paywalls, optional product analytics, hosting, and communications. Their services may be governed by separate terms and policies. Crux is not responsible for third-party services outside our control, but this does not limit rights you cannot waive under applicable law.

If you download the app through Apple, your license is also subject to Apple’s Standard End User License Agreement. Apple is not responsible for maintaining or supporting Crux. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related terms against you.

9. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or misuse the Services. Where reasonable, we will provide notice and an opportunity to address the issue. Provisions that by their nature should survive—including ownership, disclaimers, and limitations of liability—will survive termination. Termination does not automatically cancel an Apple subscription; manage it through Apple.

10. Disclaimers

To the extent permitted by law, the Services are provided “as is” and “as available.” Crux disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing. We do not warrant that the Services will be uninterrupted, error-free, secure, or accurate, or that any coaching result will improve performance or prevent injury. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

11. Limitation of liability

To the extent permitted by law, Crux and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from the Services. To the extent permitted by law, Crux’s total liability for all claims arising from the Services will not exceed the greater of US$100 or the amount you paid to Crux for the Services during the 12 months before the event giving rise to the claim.

These limits do not apply where prohibited by law, including to liability that cannot lawfully be limited. Nothing in these Terms limits mandatory consumer rights or remedies available where you live.

12. Changes to these Terms

We may update these Terms as the Services or law changes. We will post the revised Terms at this URL and update the date above. If a change materially affects your rights, we will provide additional notice where required. Changes apply prospectively. If you do not agree to revised Terms, stop using the Services and cancel any subscription before its next renewal.

13. General terms

If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, or sale of the Services. These Terms, the Privacy Policy, the terms shown at purchase, and applicable platform terms form the agreement between you and Crux concerning the Services.

Applicable law and courts will be determined under otherwise applicable law, without depriving you of mandatory protections in your place of residence. Before filing a formal claim, please contact us and give us a reasonable opportunity to resolve it.
